Sept. 29, 2008 - Today, iMEGA filed its brief with the US Court of Appeals, 3rd Circuit, in the matter of iMEGA v. Keisler, et al. The suit challenges the constitutionality of the Unlawful Internet Gambling Enforcement Act of 2006 (UIGEA), which prohibits US financial institutions from processing transactions between online gambling sites and US players, while shifting the determination, burden and cost of enforcement onto the financial institutions.

[UIGEA] Poker News Daily - iMEGA to File Internet Gambling Case in September (08/15/08)

Several months after being granted standing to sue by a judge in New Jersey, the Interactive Media Entertainment and Gaming Association has indicated that the deadline for the organization to file its brief in the Third Circuit Court of Appeals is at the end of September. iMEGA President Ed Leyden told PokerNewsDaily.com, “We’re diligently working on preparing our case and we will file by the end of next month.” iMEGA is suing to declare the Unlawful Internet Gambling Enforcement Act unconstitutional on the grounds that it violates privacy rights in the United States. iMEGA was formed in 2007 “with the goal of working constructively and cooperatively with government at all levels, and other concerned citizens and corporations, to continue the remarkable growth of the Internet, and to promote innovation, openness and freedom as the path to even greater benefit of this medium for all,” according to its website, iMEGA.org.

It’s been a roller coaster ride for the online poker industry over the last month. In June, HR 5767, which would have suspended the regulations of the Unlawful Internet Gambling Enforcement Act, was defeated in Committee by virtue of a verbal vote. Last week, Democrats in Congress struck back. Jim McDermott, from Washington State, introduced legislation that would earmark up to $40 billion over the next ten years to underserved populations for job training and educational assistance.
