The Unlawful Internet Gambling Enforcement Act (UIGEA) is in reality the LEGISLATED GAMBLING ACT (LGA) in that it declares certain “wagering” activities to not be defined as gambling.<br /> This includes with limited to NO state restrictions since Congress has declared them to be NOT defined as gaming by children as young as age 13 with parents permission* the following:</p> <p>a. Fantasy Football for prizes, the minimum age requirement at NFL.com, ESPN.com and other sites. Minimum age, 13.</p> <p>b. Educational Games are allowed, these can be played free by anyone age 13, for real money at age 18 via AOL, MSN, YAHOO and other skill gaming sites.</p> <p>c. Contests (undefined as to what these actually are) are allowed under the UIGEA (LGA). These can be played as in number three and include card games such as Hearts, Spades and Solitaire along with games such as Chess and Backgammon. Minimum age 13 for free play, 18 for money.</p> <p>d. There are no defined regulations for ANY of this; ALL may be played free by children and for money, hundreds of dollars in-fact by ANYONE age 18.</p> <p>2. Betting on Horse Racing is allowed where allowed by state law in a separate section of the UIGEA.</p> <p>Next I did the following:</p> <p>· I created a FAKE child named jimmy and a set of e-mails, one for a fake child and one for the parents.<br /> · Any REAL child need only create one for his parents<br /> · A child then can enter any and ALL sweepstakes AND CONTESTS.<br /> · See the link for the FAKE 13 year old that contains a solicitation to play for REAL money.<br /> <a href="http://games.espn.go.com/ffl/content?page=fflruleslegal2008" rel="nofollow">http://games.espn.go.com/ffl/content?page=fflruleslegal2008</a><br /> · THIS is what the GOP is claiming the UIGEA prevents, gambling by children and in homes.</p> <p>Here, is the notice beginning from the e-mail sent to the fake parents e-mail address:</p> <p>Dear Parent or Guardian of Jimmy,</p> <p>Your child has just registered at ESPN.com and will now<br /> have access to certain features <strong>(such as the ability to enter<br /> sweepstakes and contests) of the Internet sites of the<br /> Walt Disney Internet Group ("WDIG") including Disney.com,<br /> ABCNEWS.com, ABC.com, ESPN.com, FamilyFun.com and many more.</strong><br /> As a result, we want to make you aware of all of the information<br /> below so that you can communicate with us about whether and to<br /> what extent you want your child to participate in the features<br /> available on the WDIG Sites:</p> <p>1. Kids' Privacy Policy. We have a comprehensive privacy policy<br /> regarding kids that we encourage you to read. Our kids' privacy<br /> policy describes how we collect and use personal information collected<br /> online from children. It also describes how parents can review the<br /> personal information we have collected. A link to our privacy policies<br /> (including the kids' privacy policy) is posted at the bottom of each<br /> WDIG Site. A copy of our kids' privacy policy is also attached to the<br /> end of this e-mail.</p> <p>2. Parent Notifications. During the registration process, your child<br /> was asked to provide us with his/her first name, birth date, a<br /> parent's e-mail address and a member name and password. We collected<br /> this information to enable your child to request to participate in<br /> certain activities on our sites that require that we respond more than<br /> once to your child's specific request. For example, if your child<br /> both enters and then wins a sweepstakes or contest, we will send a<br /> notice to your e-mail address. We also use your e-mail address to send<br /> you this notice and future notices about your child's account. Unless<br /> you give us your express consent, we will not collect any additional<br /> personal information from your child.</p> <p>3. Parents Can Revoke Registration. We allow parents to revoke their<br /> child's registration with us at any time. If you revoke your child's<br /> registration, we will delete the personal information that your child<br /> has provided to us.
