<description>&#60;p&#62;Poker is a game that combines skill and chance. The debatable issue is how much is skill and how much is chance.&#60;/p&#62;
&#60;p&#62;On any 1 given hand, chance plays a large part. A novice player dealt a straight flush has a &#34;pretty good&#34; chance of beating a seasoned pro. However, the more hands you play the more skill comes into play. &#60;/p&#62;
&#60;p&#62;This is why in cash games, over a period of time, the better more skilled players win more consistently. Conversely, we have all seen tournaments where the &#34;pro&#34; walks away shaking his head after being eliminated by a novice who made what would be considered a &#34;questionable&#34; play.&#60;/p&#62;
&#60;p&#62;This is why tournaments are played over periods of time not simply 1 hand.&#60;/p&#62;
&#60;p&#62;The everlasting argument has and always will be the percentage of skill vs. chance.

<description>&#60;p&#62;Try going to the local newspapers and find the political columnists. Contact them and make them aware that you are getting no response from your local representatives after numerous attempts.&#60;/p&#62;
&#60;p&#62;It is not important to discuss the issue with them just the fact that you are being ignored by your representatives.&#60;/p&#62;
&#60;p&#62;Also contact the party leader in the House for the representatives and advise them of the lack of contact. Again, the issue is not important. &#60;/p&#62;
&#60;p&#62;The key emphasis should be on the lack of contact, not the issue.

&#60;p&#62;New York, New York (November 10, 2008) - The Free Poker Experience, LLC, a Missouri limited liability company has filed an action in the Supreme Court of the State of New York, County of New York (No.: 650328/2008) to prove that New York Penal Law is unconstitutional under both the state and federal constitutions when applied to free poker. &#60;/p&#62;
&#60;p&#62;The Free Poker Experience represents Free Poker Network, Inc., (http://www.freepokernetwork.com) a company that organizes free-to-play Texas Holdem poker tournaments hosted by participating sponsors (bars, restaurants, taverns, etc.). The tournaments are 100% FREE –to-play in and are for entertainment purposes only; players are never charged a fee of any kind to play. The player risks nothing and can lose nothing.&#60;/p&#62;
&#60;p&#62;The New York State Penal Law (§ 225) states that playing any game wherein you risk “something of value” is gambling. The State further defines “something of value” as anything “…involving entertainment or a privilege of playing at a game or scheme without charge.&#60;/p&#62;
&#60;p&#62;New York State Penal Law seeks to have nothing defined as something and to impermissibly broaden the definition of gambling past any reason or constitutional test; because the player is entertained, enjoys the exercise or even dares to engage in the game, according to Benjamin Scheck, managing member of The Free Poker Experience.&#60;/p&#62;

I once heard that if a certain percentage goes to a non profit organization that it was perfectly legal?  Would this qualify under the bone fide law or how creative am I going to have to get?

I wish he would because frankly I'm tired of paying taxes, working hard,  and being a law abiding citizen who can't sit down at my computer and use my credit card to load my poker account,or my bank account to get my winnings when I cash out. He has to do something about the economy first. Don't ask me what but he has to do something, or at least act as though he is doing something.&#60;/p&#62;
&#60;p&#62;Probably the only chance we have is if one of his new 'appointees' realizes the government is missing out on a large amount of tax revenue by not taxing our winnings. Do I want to pay taxes on my winnings? NO.....but it will probably be the only way to get our rights to play back.&#60;/p&#62;
&#60;p&#62;Let's look at the pros and cons of the government taxing online poker winnings...&#60;/p&#62;
&#60;p&#62;&#60;strong&#62;PRO&#60;/strong&#62;-It will be easy for us to deposit and cash out (remember the good ole days when you could cash out and have the money in your bank account within 24 hours?)&#60;/p&#62;
&#60;p&#62;&#60;strong&#62;PRO&#60;/strong&#62;-With the taxation comes some type of regulation (Maybe the UB and Absolute scandals would not have occurred with some govt regulation)&#60;/p&#62;
&#60;p&#62;&#60;strong&#62;Con&#60;/strong&#62;-With the taxation comes some type of regulation. We all know the government could possibly make it worse. Politicans are politicans and some decisions they make have us wondering 'if they are playing with a full deck' (pun intended)&#60;/p&#62;
&#60;p&#62;&#60;strong&#62;Con&#60;/strong&#62;-The taxation could be so extreme that you might not want to cash out a small amount, because your $500/hr winning rate is reduced to $250 or $300/hr after taxes.&#60;/p&#62;
&#60;p&#62;&#60;strong&#62;Pro&#60;/strong&#62;-Poker (both online and at brick and mortar casinos) could again gain a large number of new players.&#60;/p&#62;
&#60;p&#62;&#60;strong&#62;Pro&#60;/strong&#62;-The Republican Party will not have an easy time trying to enact legislation to ban online poker. For those of you who might be unaware, the Republican Party stated in their manifesto (sorry I mean party platform) that they wanted to BAN all online poker. &#60;p&#62;Online poker is not illegal in the state, but I believe there are some sites which we are not able to receive any type of monetary prize. I could be wrong, but I believe it is the sites where you pay a flat monthly fee (membership fee) and then play for prizes (including cash). I believe it is illegal (or has been interpeted to be by attorneys) due to the sweepstakes laws in our state. I know there are sites of this type where we cannot receive any prizes, but we can still play 'free'.&#60;/p&#62;

There is no money lost or placed to start with, and everything gained would be a prize from a free game.&#60;/p&#62;
&#60;p&#62;I've heard that there is a casino here in the state that has a room for 18, 19, and 20 year old players to play poker (although the gambling age is 21 for live play) but have not checked on that yet. If this is true (have heard it from several people that go to that casino weekly), would it make sense to assume that playing Full Tilt with only money won without staking would be a legal way to play at age 18?

&#60;p&#62;Colorado has a pretty liberal social gaming exception in its law, and based on what you say I would conclude you violated no law. But the State Police in Colorado seem to have a  real problem with poker (maybe the head guy suffered one too many bad beats) and aggressively prosecute and investigate.&#60;/p&#62;

<description>&#60;p&#62;Mikern, first two hands, you slowplayed AQ and JJ, good hands, but hands that get outdrawn on more often than they win. Then you ended up all in with them, so you set yourself up by limping to a certain extent.  Personally, I would only consider doing that with AA, maybe KK, but even then, I would realize my own trap backfired on me.  Yeah, they are bad beats, but they are in the 20-30% range, meaning that one out of every four times you put yourself in those situations, you will lose, so there is nothing out of the ordinary there, not to mention that both the A5 and the 33 might have folded, or at least only called, had you raised instead of limped in to begin with, in which case, you could have easily won both hands with a continuation flop bet.  &#60;/p&#62;
&#60;p&#62;Third hand, you gave a free card to two open ended straight draws on the turn; you really deserve to lose that one.&#60;/p&#62;
&#60;p&#62;I’m not going to keep reading the histories.  This is pretty poor evidence for your arguments so far.&#60;/p&#62;
&#60;p&#62;Based on your later posts, it sounds like maybe some of the more ridiculous beats were later on, but you're obviously not playing optimal poker here either, so you bear some of the responsibility for your losses.&#60;/p&#62;
&#60;p&#62;Trust me, the higher in limits you go, it gets tougher to win.  The online pros don't play your limits, so you will see a very different style of play at higher limits.  It cannot even be compared.  The lower limits are easier to beat with straightforward mathematical play.  The higher limits emphasize more reading, deception, etc. because everyone knows the math.  But although easier to beat, the lower limits will always have many more bad beats.  I can see how this would seem &#34;rigged&#34; but there is a very simple mathematical reason for this.  The lower limits have a much higher percentage of bad players, or players that simply don't care about losing 50 cents so they will go all in with any two cards.  Let's say they are going in with cards that have a 10% chance of winning.  They will still win 10 out of every 100 times they do this.  Since it happens so often at low limits, even at 10% odds you will see it happen a lot.  Furthermore, the better you play, the more bad beats you will take.  This is also a statistical fact because the better you play, the more often you have the best cards when the chips go in.  If you never bet when you're behind, you can't give bad beats, you can only take them, so taking a lot of bad beats, as weird as it may sound, is actually a sign of playing well, although that may not encourage you very much.&#60;/p&#62;
&#60;p&#62;Paulie, mikern doesn't need your defense.  If he goes into a POKER PLAYERS alliance forum and argues against legalizing online poker, he should expect to get some strong arguments in response.  BTW, I design military airplanes for a living.  Care to comment on whether or not this is a valid contribution to society?  If anything we did or fought for had to pass such muster, this country may not have been founded based on people not wanting to pay taxes on tea (I guess those guys were also unpatriotic because they did not want to give money to the government).  You better believe that if all of a sudden, the government made playing professional football illegal based on the fact that players &#34;could&#34; get hurt, and addictive sports gamblers &#34;could&#34; hurt their families, there would probably be a Football Players Alliance fighting like cats and dogs to get such idiotic law reversed.  And how do you know that we are not also fighting hard for other &#34;important&#34; issues we care about?  I concede that there may be more important issues, but this one is not unimportant, for many reasons, many of which have been argued in this thread and others here.  If nothing else, think of this: what's next?  If we bend over while they take this freedom away, what will they think they can get away with next time?  The government should be scared of taking ANY freedom away from the people.  &#60;/p&#62;
&#60;p&#62;BTW, the only reason unpatriotic people like me don't go to casinos is because there isn't one I can go to without getting on an airplane and staying at an overpriced hotel.  The casinos you support so much would love to have a chance to offer online extensions of themselves to us, but the government will not let them.  We would gladly sponsor them.  Both the consumers and providers in this industry would accept the taxation and regulation that would come with legalization, so don't blame the &#34;unpatriotic leech online poker players&#34;, as you apparently view us, blame your government for forcing us to go underground to play the game that we love.  The majority of the PPA, Flintstone and others notwithstanding, is made up of people with taxed jobs (I guess that means we are valuable contributors to society), who love this game and are vehemently opposed to any attempt by the government to take away our right to play it.  You are within your right to not call your Senator, but don't berate those of us who love our freedom more than you do and choose to take action to defend it.  We are not hurting this country; we are trying to make it better.  You will find very few people in the PPA, if any, arguing against taxation of our winnings.  Even in this very thread people are arguing for it.  Flintstone's point was less about the loss of the job than it was about the money he could be spending IN THIS COUNTRY if the government let him bring it in, and even more so, about the potential revenue the government could have to do something beneficial with (hopefully) if they did allow us to contribute more via taxation.  When have you ever heard of anybody else pretty much begging to be taxed?  Now that I think about it, by your rationale, we are the most patriotic lot.  While everyone else is voting for Obama so that they can get their share of the middle tax cut, while they're paying big money to H&#38;#38;R Block so they can pay the absolute minimum allowed, we are asking to pay more.

&#60;p&#62;Yes it’s true. Not only in New York, but in as many as 30 other states it is ILLEGAL for you and your friends to sit down and play a friendly game of Poker even if there is NO MONEY involved. &#60;/p&#62;
&#60;p&#62;Throughout this great country many states allow what is referred to as “bar or tavern” poker. In this game you join a poker league at a local “sponsor” (bar, tavern, restaurant, etc.) then compete on a weekly basis for prizes ranging from merchandise to cash to entry into major tournaments such as the World Series of Poker. The tournaments are for entertainment purposes only and entry into the league and tournaments is FREE. Players begin each session of play with an equal amount of tournament chips and are never charged a fee of any kind to play. The player risks nothing and can loose nothing.&#60;/p&#62;
&#60;p&#62;The New York State Penal Code (§ 225) states that playing any game wherein you risk “something of value” is gambling. The State further defines “something of value” as anything “…involving extension of a service, entertainment or a privilege of playing at a game or scheme without charge.” This law makes it illegal to play in or sponsor a FREE poker tournament where there is no entry fee of any kind and absolutely no risk of loss to the player. Further, in the State of New York   any “sponsor” would be promoting gambling and subject to having their liquor license suspended.&#60;br /&#62;
If this standard was applied evenly and fairly any competitive game played for entertainment (i.e. bridge, volleyball, bowling, darts, etc.) would be gambling. Unfortunately that is not the case as poker is singled out as gambling while all other competitive games are allowed to be played.&#60;/p&#62;
&#60;p&#62;Our position is simple. If you pay nothing to play, have no risk and can loose nothing then there is no gamble.&#60;/p&#62;
&#60;p&#62;We have filed an action in the Supreme Court of the State of New York, County of New York (case No.: 650328/2008)  claiming that the law, as written and applied is unconstitutional and a violation of the 14th Amendment of the United States Constitution calling for equal protection under the law. If you ban FREE poker then you must ban all FREE games wherein the player can win “something of value.” &#60;/p&#62;
&#60;p&#62;We are fighting the Government to protect your right to play FREE Poker. To win we need strong, vocal support and active involvement from you, the poker playing public. With this in mind, I urge you to support our action by writing letters to the Court and sending them to The FREE Poker Experience for use in the litigation process.&#60;br /&#62;
There is nothing more important that you, the poker playing public can do to promote and defend the great game of poker then to help us help you in defending the great game of poker.&#60;/p&#62;

&#60;p&#62; I work at a pool room/bar in Colorado and a couple of weeks ago these guys wanted to use some chips so they could play cards. So, I gave them some chips that we use for the free poker tournament. I didn't ask if the where going to be playing for anything. They played heads up and one of the men ended up losing $500 to the other guy. The guy that lost calls the cops but nothing was done about it. A week later we get raided by the gaming police. They say that we could be charged with a felony. They search the whole bar and we are going to be put on a watch list and get searched randomly and they are going to send in under covers. I thought that people where allowed to gamble amongst themselves if the house was not taking a rake or tips?

Are you really that short sighted to say you being out of a &#34;job&#34; would hurt this economy? Where do you suppose the money comes from to fund people's accounts to play poker in the first place? Without real jobs supplying the poker community with money, you would be raked out of existence. Without that constant influx of money, you and all of your other jobless online &#34;friends&#34; would be forced to move from this country (a good thing) or forced to get off your fat arse and get a real job that does help this economy (another good thing.)&#60;br /&#62;
Please read this very carefully; YOU DO ABSOLUTELY NOTHING FOR THIS COUNTRY. On top of that, you actually HURT this country because you play online versus a casino. Casino's in this country either gift money or are forced to give money to the Fed. When have you ever heard of Pokerstars or Full tilt sending money to your government?&#60;br /&#62;
Not to mention the fact surely many of you online players don't fully disclose your winnings so that you have to pay less in taxes. Another way you're hurting this country. &#60;/p&#62;
&#60;p&#62;You may have read this far and assume I'm against online poker but I'm not. I'm against idiots who suck this country for all they can and then cry when it gets a little tougher for them. &#60;/p&#62;
&#60;p&#62;Mikern12 has a very good point and he gets backlashed for it. Although we all love poker and we SHOULD DEFEND IT, if we worried/fought this hard for other issues that are MUCH MORE important, can you imagine how truly great this country could be?&#60;/p&#62;
&#60;p&#62;Poker should be defended because it is a fabulous game and it is or should be our right in this country of freedom to play it when we want. But if you think I'm gonna write to my Senator so that you lazy mofo's can continue to sit on your arse's while the rest of us go out and work real jobs that help real people and contribute to a real society, you're in for the worst beat of your life. &#60;/p&#62;

&#60;p&#62;Thank you for taking the time to contact me regarding the Unlawful Internet Gambling Enforcement Act of 2006 (UIGEA). I appreciate hearing from all Pennsylvanians about the issues that matter most to them.&#60;/p&#62;
&#60;p&#62;UIGEA cuts off revenue streams to unlawful Internet gambling businesses. It prohibits the receipt of checks, credit card charges and electronic funds transfers by such businesses. Banks, credit card issuers and other payment system participants have been enlisted to help cut off these revenue streams.&#60;/p&#62;
&#60;p&#62;Currently there are a number of bills in the House of Representatives which deal with the regulation of Internet gambling. These bills would help better define some of the ambiguities found in the UIGEA. H.R. 5767 would place a moratorium on UIGEA. H.R. 2610, the Skill Game Protection Act, would exempt poker and other games of skill from federal prohibition. H.R. 2046, the Internet Gambling and Regulation Enforcement Act, would regulate Internet gambling. H.R. 2607, the Internet Gambling
